Our approach

How we approach divorce matters

The Divorce, Dissolution and Separation Act 2020 introduced no-fault divorce to England and Wales, removing the requirement to attribute blame and reducing unnecessary conflict at the point of dissolution. We advise on how to use this framework effectively and how to time and structure the process alongside financial proceedings for the most efficient outcome.

Financial remedy proceedings, covering the division of the matrimonial assets, are often the most complex and contested element of a divorce. Our approach is to identify your priorities early, negotiate robustly where that serves your interests, and litigate with precision where it does not. We do not prolong proceedings unnecessarily, and we are transparent about the costs of every route.

Where the marriage involves substantial assets such as business interests, investment portfolios, pension funds, trusts or property held abroad, we bring forensic attention to financial disclosure and valuation. We work closely with leading forensic accountants, pension actuaries and property valuers to ensure the full picture is before the court.

For marriages with international connections, questions of jurisdiction and forum can be as important as the substantive financial claims. We advise on where proceedings should be issued to best protect your position. Where necessary, we issue at pace to secure the most advantageous forum before the other party does.

Process

What to expect

01

Petition and conditional order

We file or respond to the divorce application and obtain the conditional order, which marks the formal recognition of the irretrievable breakdown.

02

Financial disclosure

Both parties provide full and frank financial disclosure via Form E; we scrutinise it carefully and advise on any areas requiring further investigation.

03

Negotiation and settlement

We pursue the best available outcome through solicitor negotiation, a private FDR appointment or, where necessary, a contested final hearing.

04

Final order and consent order

The financial settlement is recorded in a binding consent order approved by the court; the final order then formally dissolves the marriage.
